1. Acceptance of Terms

By accessing, downloading, or using the Oxiano platform (website, mobile application, API, or any associated product), you confirm that you have read, understood, and agree to these Terms & Conditions ("Terms") and to the Privacy Policy incorporated herein by reference. If you do not agree with any provision, please immediately cease using the platform. Continued use after the Terms are modified constitutes acceptance of the new version. Oxiano reserves the right to amend these Terms at any time, with prior notice by updating the date above or by direct communication to registered users.

2. Description of Service

Oxiano provides a quantitative sports analytics platform, currently focused on European football, including: • Probabilistic models based on XGBoost, dynamic Elo ratings, and Poisson distributions, trained on 225,000+ matches from European leagues (2005–2026) • Statistical indicators: confidence, market edge vs. bookmakers, expected value (EV), Kelly Criterion • Portfolio management tools (Combo Analyzer, Track Record) • Live standings, match data, and sports statistics provided by third parties (football-data.org, API-Football) • Email and Telegram notifications with daily auto-recalculated picks • Weekly reports and parameter interpretation guide The service is provided "as is." We reserve the right to add, modify, or remove features without prior notice.

3. Limitation of Liability

To the maximum extent permitted by applicable law, Oxiano, its directors, employees, agents, and suppliers shall not be liable for: • Direct, indirect, incidental, consequential, or punitive financial losses resulting from use of the platform • Betting, investment, or any other financial decisions made based on platform content • Inaccuracies or delays in sports data provided by third parties • Service interruptions, errors, or temporary unavailability • Unauthorized access to your account resulting from your failure to protect your credentials Model accuracy, measured exclusively on out-of-sample data (matches unseen during training), ranges from 72% to 86% depending on league and confidence threshold. Past performance does not guarantee future results. Oxiano's total maximum liability to you for any claim shall not exceed the amount paid by you for the service in the preceding 12 months, or EUR 50, whichever is lower.

4. Minimum Age and Eligibility

The platform is intended exclusively for users aged 18 years or older. By using the platform, you represent and warrant that: • You are at least 18 years of age • You have the legal capacity to enter into a binding agreement • You are not a resident of a jurisdiction where access to such services is prohibited by law • You are using the platform for lawful and personal purposes We do not knowingly collect personal data from individuals under 18. If we become aware of such data having been collected, it will be promptly deleted.

5. Permitted and Prohibited Use

Permitted use: • Accessing and using the platform for personal and educational purposes • Sharing and citing analyses with explicit source attribution (Oxiano — oxiano.com) • Using the Oxiano API in your own analytical projects, within the limits of your subscription plan Prohibited use (including but not limited to): • Reproducing, selling, or sublicensing platform content without prior written consent • Automated scraping, crawling, or mass extraction of data without a contractual agreement • Presenting Oxiano predictions as "certainties," "guarantees," or "betting tips" on any public channel • Using the platform to deceive, manipulate, or mislead third parties • Any activity that violates applicable laws, including those relating to gambling, data protection, or copyright • Attempts to gain unauthorized access to other users' systems, accounts, or data Violations may result in immediate account suspension and legal action.

6. Intellectual Property

All elements of the platform — including, without limitation, machine learning models, algorithms, source code, design, texts, graphics, the "Oxiano" trademark, and associated logo — are the exclusive property of Oxiano and are protected by copyright, trademark, and other applicable intellectual property laws. Raw sports data is provided by third parties (football-data.org, API-Football, Kaggle datasets) under their own licenses; Oxiano does not claim ownership of raw data. We grant you a limited, non-exclusive, non-commercial, and revocable license to use the platform solely for the permitted purposes described in Section 5.

7. Accounts, Subscriptions and Payments

Accounts: • Account creation is optional; certain premium features require an active subscription • You are solely responsible for the confidentiality of your credentials and for all activities conducted under your account • Notify us immediately at contact@oxiano.com in the event of any unauthorized access Subscriptions: • Paid subscriptions (Analyst, Pro) are processed via Gumroad, a registered fiscal merchant of record • Prices are displayed in RON or EUR and include VAT where applicable • Subscriptions renew monthly; you may cancel at any time from your account panel • Refunds are available within 7 days of initial purchase if the service has not been significantly used — contact contact@oxiano.com Suspension: • We reserve the right to suspend or delete accounts that violate these Terms, without refund in cases of proven violations.

8. Privacy and Data Protection

The collection and processing of your personal data is governed by our Privacy Policy, available at oxiano.com/privacy, which forms an integral part of these Terms. We process your data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Romanian data protection legislation. You have the rights of access, rectification, erasure, restriction, portability, and objection, exercisable via contact@oxiano.com.

9. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with Romanian law and applicable European Union regulations, including the GDPR and the Digital Services Act (DSA). Any dispute, controversy, or claim arising from or in connection with these Terms shall be resolved, in the first instance, amicably within 30 days of written notice. In the absence of an amicable resolution, disputes shall be submitted to the exclusive jurisdiction of the competent courts in Romania. If you are an EU resident, you also have the right to lodge a complaint with the competent supervisory authority in your member state (in Romania: ANSPDCP — www.dataprotection.ro). If any provision of these Terms is found to be null or unenforceable, the remaining provisions shall remain in full force and effect.

10. Changes to Service and Terms

Oxiano may, at any time: • Modify, suspend, or discontinue any part of the service • Update these Terms to reflect legal, technical, or commercial changes Material changes will be communicated at least 14 days in advance via email (if you have a registered account) or through a prominent notice on the platform. Continued use after the changes take effect constitutes acceptance of the updated Terms.
